  3. Be responsible for all activity that occurs under your account; and
  4. Notify us promptly of any unauthorized use.

We are not liable for any loss arising from your failure to maintain the security of your account.

4. Fees, Billing, and Refunds

Your content and data

You retain all rights to the data you upload or create within the Services ("Customer Data"). You grant us a limited license to host, process, and transmit Customer Data solely as necessary to provide the Services. You are responsible for the legality of, and your rights to use, all Customer Data.

6. Acceptable Use

You agree not to:

  1. Use the Services for any unlawful purpose or in violation of any applicable law;
  2. Upload or transmit malware, or attempt to gain unauthorized access to the Services or related systems;
  3. Interfere with or disrupt the integrity or performance of the Services;
  4. Reverse engineer or attempt to extract source code, except to the extent expressly permitted by an applicable open-source license or by law;
  5. Use the Services to send unsolicited communications (spam) in violation of applicable law; or
  6. Resell, sublicense, or otherwise commercially exploit the Services except as expressly authorized.

We may suspend or terminate access for violations of this section.

7. Third-Party Services

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA WILL BE PRESERVED WITHOUT LOSS.

You are responsible for maintaining your own backups of Customer Data.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL [LEGAL ENTITY NAME] BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnification
